MaxPro Hockey Club Shop: Terms & Conditions

Welcome to the MaxPro Hockey Club online shop at shop.maxprohockeyclub.com (the “Shop”). These Terms and Conditions (the “Terms”) govern your access to and use of the Shop, and your purchase of products through the Shop. By accessing or using the Shop, you agree to be bound by these Terms and by all applicable laws and regulations. If you do not agree, you must not use the Shop.

These Terms apply only to merchandise orders placed through the Shop. Hockey training programs, clinics, in-season training, and other services offered through our primary website at www.maxprohockeyclub.com are governed by the MaxPro Hockey Club Website Terms of Use, program waivers, and other applicable agreements presented on that site.

You must be at least 18 years old or have parental or guardian permission to place an order through the Shop. By using the Shop, you represent that you meet this requirement and that all information provided in connection with your order is accurate and complete.

All products listed on the Shop are subject to availability. We reserve the right to limit quantities, discontinue products, and update product information at any time without notice.

We make reasonable efforts to describe our products accurately, including colors, sizing, and materials. However, product images are for illustrative purposes only. We do not guarantee that your device’s display will accurately reflect the actual colors or appearance of any product. Sizing charts are provided by the manufacturer and are for general guidance only. You are responsible for reviewing sizing information before placing an order.

Your placement of an order is an offer to purchase the products in your cart. We may accept, reject, or place limitations on any order in our discretion, including in cases of suspected fraud, unauthorized activity, or errors in pricing or product information.

If we cancel all or part of your order after your payment method has been charged, we will issue a refund for the affected portion. We reserve the right to correct pricing and other errors on the Shop at any time, including after an order has been submitted, and to cancel any orders arising from such errors.

All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes, shipping, and handling, all of which will be calculated and displayed at checkout.

Applicable sales tax and other government imposed fees will be added at checkout where required by law. You are responsible for all such taxes and fees associated with your purchase, except for taxes on our net income.

From time to time, we may offer promotions, discounts, or coupon codes. Such promotions may be subject to additional terms and limitations. Promotions are valid only for the time period and in the manner expressly stated and cannot be applied retroactively to prior purchases or combined unless we clearly state otherwise.

We accept major credit and debit cards through our secure payment processors, which may include WooPayments and Stripe, as indicated at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us or our payment processors to charge the total amount of your order, including any applicable taxes, shipping, and handling.

If your payment method is declined or if your payment cannot be processed for any reason, your order may be delayed or canceled. You remain responsible for any amounts that remain unpaid.

Shipping options, charges, and estimated delivery times will be displayed at checkout and are further described in our Shipping Policy, which is incorporated into these Terms by reference.

Title to and risk of loss for products passes to you when we deliver the products to the carrier for shipment. Once the carrier confirms delivery to the shipping address you provided, we are not responsible for lost, stolen, or misdelivered packages, although we may, in our discretion, assist you in working with the carrier.

We are not responsible for delays in shipping or delivery that are caused by carriers, customs, weather, or other circumstances beyond our reasonable control.

Our current practices regarding returns, exchanges, and refunds are described in our Refund and Returns Policy, which is incorporated by reference into these Terms. Please review that policy carefully before completing your purchase.

Unless otherwise stated in our Refund and Returns Policy or required by applicable law, items may generally be returned within 30 days of delivery if unused, unworn, and in their original packaging. Custom or personalized items are typically non refundable except in the case of a manufacturing defect or if otherwise required by law.

Refunds, when approved, will be issued to the original payment method after we receive and inspect the returned item. Unless the item was defective or incorrect, you are responsible for return shipping costs.

You may choose to create an account on the Shop for faster checkout, order history, and related features. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to notify us promptly of any unauthorized access to or use of your account or any other breach of security. We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe that it is being used in violation of these Terms or for any unlawful or improper purpose.

All content on the Shop, including logos, images, text, graphics, and designs, is the property of MaxPro Hockey Club LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Shop without our prior written consent.

The Shop is operated on a third party e commerce platform and uses third party service providers, including payment processors and shipping carriers, to process orders and deliver products. Your use of those services may also be subject to the terms and privacy policies of those third parties. We are not responsible for the acts or omissions of those third parties, but we will take reasonable steps to address issues that arise in connection with your orders.

To the fullest extent permitted by law, MaxPro Hockey Club LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Shop or any product purchased through the Shop. Our total liability for any claim related to a product you purchase shall not exceed the purchase price of that product.

You agree to indemnify, defend, and hold harmless MaxPro Hockey Club LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your breach of these Terms or your misuse of the Shop or any products purchased through the Shop.

We will not be liable for any failure or delay in performance to the extent caused by events beyond our reasonable control, including acts of God, acts of government, labor disputes, pandemics, war, natural disasters, or interruptions of internet or other utility services.

These Terms and any disputes arising out of or related to your use of the Shop or any products purchased through the Shop shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of or related to these Terms or your use of the Shop shall be instituted exclusively in the state or federal courts located in Boston, Massachusetts, and you consent to the personal jurisdiction of such courts and waive any objection to venue in those courts.

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Shop after any changes become effective constitutes your acceptance of the revised Terms.
